Landfill Officials Hope to Overturn Court Rulings




The Stark-Tuscarawas-Wayne Joint Solid Waste District Board of Directors has decided to appeal a recent ruling from the 5th District Court of Appeals in Canton.

 

Last month, the Court issued a ruling in regards to the District’s fight to prevent counties with lower recycling rates from dumping waste in the District, ruling that the District could not enforce such rules.

 

Tuscarawas County Commissioner Kerry Metzger says several years ago, the National Solid Waste Association took the District to Court regarding their rules, which the District originally won, but says was still later appealed.

 

During Friday's Board of Directors Meeting, however, Metzger says the District has now decided to appeal that particular ruling to the Ohio Supreme Court.

Meztger says there have been times in the past when the rules, set forth by the Ohio EPA, were not enough.

Also during Friday's meeting, the Board of Directors decided to move forward with an appeal to the Ohio Environmental Review Appeals Commission in Columbus in regards to American Landfill's recent Clean Air Permit, received back in December of 2009 by the Ohio EPA.

 

Last month, the Solid Waste District and a group of residents filed a lawsuit in U.S. District Court in Akron against American Landfill Incorporated located in Stark County and its parent company Waste Management Incorporated based in Texas.

The lawsuit accuses the defendants of polluting the environment and claims that the Landfill allegedly accepted aluminum dross waste, which they are allegedly not storing properly.

 

American Landfill Officials, however, continue to maintain that the claims are groundless.
