Mary Alice Reporting – Two men appeared in court this week, for their respective cases, with competency the main focus of the hearing.

The first case up was 40-year-old Dwain Smith, who is charged with multiple counts of rape, gross sexual imposition, and sexual battery involving incidents when the child was four to 16 years old.

Tuscarawas County Assistant Prosecutor Bob Urban explains that Smith’s case was continued as the competency and insanity evaluation still needs to be conducted. Also, Smith requested a new attorney to be appointed.

In the second competency hearing, it was for 33-year-old Gregory Emanuel Jr., who faces charges of attempted murder and felonious assault after an August incident where he barricaded himself inside an Atwood Terrace Apartment before attacking New Philadelphia Police Officers with a hatchet.

Urban notes that, while an evaluation was conducted for Emanuel, the defense has requested a second sanity assessment.

He explains that a competency evaluation relates to a defendant’s understanding of what they’re charged with and the sanity evaluation is based on the state of mind at the time of the incident.

Both defendants remain in the Tuscarawas County Jail.
