
A class action suit is filed against the City of Uhrichsville to reclaim landlord registration fees that have since been ruled as collected illegally.
The latest filing, on April 24th, is on behalf of all owners of rental residential properties located within city limits.
An unconstitutional ruling was issued on December 10, 2024 following a brief Tuscarawas County Common Pleas Court trial over Uhrichsville collecting a landlord registration fee for $25 per unit in 2020 and then $50 from 2021 through 2024.
Kevin and Gerald Barker filed the lawsuit and are “formally requesting a refund of all illegal taxes paid for all years listed”. The suit goes on to mention that the taxes “were illegally collected under now defunct ordinance 7-20” with accompanying “documents that show proof of payments”.
For Kevin, the amount, over the five years, totals $900 and for Gerald, $675.
City Law Director Jeff Merklin’s comment was that he “received a copy of the proposed class action late last week, so I can’t make any specific comments at this time”.
A pretrial conference is scheduled for July 25th.
