A civil complaint filed by MBS Baseball Holdings last week alleges misconduct by one of the co-owners.

The sports complex located on Arrowhead Road in Bolivar is co-owned by John Massarelli and two others.

The Tuscarawas County Common Pleas Court filing alleges that Massarelli, of Massillon, bypassed their operating systems and accepted cash for lessons, failed to document the lessons, and withheld full payments. MBS says there has been “theft and conversion of as much as $100,000 in cash payments related to baseball instruction and fees, which he was wrongfully keeping off official records”.

MBS also claims Massarelli showed up at the facility intoxicated, even when teaching lessons.

Massarelli was removed from daily participations following an October 21st MBS members meeting. According to the complaint, a cease and desist was also served, but Massarelli has continued to appear on the businesses premises and holding coaching sessions with clients.

The judge has granted a temporary restraining order. An oral hearing is scheduled for November 3rd.
