The case of a New Philadelphia man accused of attempting to murder a police officer during an arrest attempt is heading to the grand jury.
28-year-old Dyllan Riter waived his right to a preliminary hearing Wednesday. New Philadelphia Municipal Court Judge Nan Von Allman forwarded the case to Tuscarawas County Common Pleas Court where the grand jury will consider a likely indictment.
Riter is charged with three felonies – attempted murder of a police officer, felonious assault of a police officer and theft of a firearm. Police say when three officers attempted to arrest him last week, Riter got a hand on one of their guns during the scuffle and fired a shot that missed an officer by inches. There is police bodycam video on the New Philadelphia Police Department’s Facebook page.
Riter is being held the Tuscarawas County Jail with a 300-thousand dollar bond.
He also faces charges in Stark County for a pair of robberies at Dollar General Stores.
