A New Philadelphia man accused of selling cocaine to undercover officers in the neighborhood around a Dover elementary school will be on probation for three years. 

27-year-old Cullen Brogan was sentenced Tuesday after reaching a plea agreement with prosecutors in June. In exchange for his plea, prosecutors reduced the felony level on one of five felony charges, including trafficking in cocaine. 

However, Prosecutor Lacee Felix objected to the agreement after Brogan missed pre-sentence investigation interviews and failed a drug test less than two weeks ago.

Brogan told assigned Judge Edward O’Farrell he has battled addiction his entire adult life.

O’Farrell said Brogan would go to jail if he failed another drug test. He reserved a six-year prison sentence if Brogan violated the terms of his probation. Those terms include completion of a six-month treatment program and refraining from drug use. 

Brogan was arrested last year after police said Brogan sold drugs on three occasions to undercover agents within 1,000 feet of Dover Avenue Elementary School.
